Please read these Terms of Service carefully before using the Storyburst app. These terms constitute a legally binding agreement.

Acceptance of Terms

By accessing or using Storyburst, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our service.

User Accounts

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 13 years old to create an account
• Parents or legal guardians must create and manage accounts for children under 13
• One person may not create multiple accounts
• You must notify us immediately of any unauthorized use of your account

Subscription Services and Credits

Subscriptions

• Subscription fees are charged in advance on a recurring basis
• Cancellations take effect at the end of the current billing period
• No refunds are provided for any reason, including partial months of service
• Prices may change with 30 days advance notice
• Free trials automatically convert to paid subscriptions unless cancelled
• Payment information must be kept current and valid
• Subscriptions may be subject to local taxes and fees
• Different subscription tiers may offer varying benefits and features
• Subscription status affects credit earning rates and bonuses
• All purchases are final and non-refundable

Credits System

• Credits are required to create stories
• Each story creation costs a specific number of credits
• Credits can be earned through subscriptions or purchased separately
• All credits, whether purchased or earned, may expire if not used within 12 months
• Credits are strictly non-transferable between accounts
• Credits are non-refundable under any circumstances
• Credit purchases are final and cannot be reversed
• Credit prices and story creation costs may change without notice
• Subscription-earned credits expire at end of subscription period
• Credits have no cash value and cannot be exchanged for money
• Unused credits are forfeited upon account termination
• We reserve the right to expire or remove credits at any time
• No refunds will be provided for unused or expired credits

Story Creation

• Each story requires a specific number of credits to create
• Credit costs may vary based on story length, complexity, or features
• Credits are deducted upon story creation initiation
• Credits used for failed story creations are non-refundable
• Created stories remain accessible according to your subscription status
• We reserve the right to modify credit costs for story creation
• Story creation failures do not guarantee credit refunds

Content Guidelines

• Users must not create or share inappropriate or harmful content
• We reserve the right to remove content that violates our policies without notice
• Users retain rights to their personal information and profile data
• We may feature user profiles and testimonials for promotional purposes with explicit consent
• Content must not infringe on third-party rights
• Content must be appropriate for children
• We maintain strict content moderation for child safety
• Parents can review and request removal of their child's information
• We comply with COPPA and other child protection regulations

App Store Purchases and Subscriptions

• All purchases are processed through the App Store payment system
• Subscriptions will automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions through your App Store account settings
• Any unused portion of a free trial period will be forfeited when purchasing a subscription
• Subscription prices may change with notice; your consent will be required for any price changes
• Family Sharing may be enabled for in-app purchases and subscriptions
• Apple is not responsible for the content or functionality of the app

Intellectual Property and Content Ownership

• Storyburst retains all rights to the app, its content, and all AI-generated content
• Users may not copy, modify, distribute, or create derivative works from any content
• All stories, illustrations, and other content created through our service are the exclusive property of Storyburst
• Users receive a limited, non-exclusive license to view and use content for personal, non-commercial purposes
• Users may not claim ownership or copyright over any AI-generated or platform-created content
• We may use, modify, adapt, and redistribute any content created through our service
• Users grant us perpetual rights to any user-provided inputs used in content generation
• DMCA compliance and takedown procedures are honored for third-party content

AI-Generated Content

Our service uses artificial intelligence to generate stories and illustrations. All AI-generated content is owned exclusively by Storyburst. Users acknowledge that:

• All AI-generated content remains the exclusive intellectual property of Storyburst
• Users receive a limited license to view and use content within the app
• Content may not be extracted, copied, or used outside the platform
• We maintain exclusive rights to modify, adapt, or reuse any generated content
• AI-generated content may have imperfections or inconsistencies
• We do not guarantee the uniqueness of generated content
• Users should review AI-generated content before sharing
• We maintain the right to improve and modify our AI systems
• We are not liable for AI-generated content accuracy
• Commercial use of generated content is strictly prohibited
• Sharing or redistributing content outside the platform is not permitted

Data Storage and Security

• We implement industry-standard security measures
• User data is stored securely in the cloud
• We maintain regular backups of user data
• Users are responsible for their own device security
• We may delete inactive accounts after extended periods

Termination

We reserve the right to terminate or suspend access to our service immediately, without prior notice or liability, for any violation of these Terms or for any other reason at our sole discretion. Upon termination:

• All rights granted to you will cease immediately
• You must cease all use of the service
• Outstanding payments remain due
• User content may be retained or deleted at our discretion

Changes to Terms

We may modify these terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the app after changes constitutes acceptance of new terms.

Limitation of Liability

Storyburst is provided "as is" without warranties of any kind, either express or implied. We are not liable for any damages arising from:

• Use or inability to use the service
• Data loss or corruption
• Unauthorized access to your account
• Service interruptions or modifications
• Third-party actions or content

Dispute Resolution

Any disputes arising from these Terms will be governed by the laws of the jurisdiction in which we operate. Users agree to first attempt to resolve disputes informally before pursuing legal action.
